Terms & Conditions
Last Updated: 15 April 2025
These Terms and Conditions govern your use of the Sejahtera website at sejahteram.live and describe the basis on which Sejahtera Legal Chambers ("Sejahtera", "we", "us") provides legal services to clients in Malaysia. Please read them carefully before using this website or engaging our services.
By accessing this website or requesting services from Sejahtera, you indicate that you have read and understood these terms. If any part of these terms is unclear or gives rise to questions, we welcome you to reach out to us before proceeding.
Contents
1. Acceptance of Terms
By using this website or communicating with Sejahtera for the purpose of obtaining legal services, you confirm that you are at least 18 years of age and legally capable of entering into a binding agreement. If you are acting on behalf of a company or estate, you confirm that you have the authority to do so.
These terms apply alongside any separate engagement letter or client agreement entered into with Sejahtera. In the event of any inconsistency between these terms and a specific engagement letter, the engagement letter will take precedence in relation to the matters it addresses.
2. Nature of Information on This Website
The content on this website is provided for general informational purposes and does not constitute legal advice. Inheritance and estate planning matters are highly fact-specific, and the information presented here should not be relied upon as a substitute for obtaining proper legal advice tailored to your particular circumstances.
Topics such as Faraid distribution, testamentary arrangements, trust structuring, and probate procedures vary significantly depending on individual family circumstances, the nature and location of assets, and the applicable legal framework. We encourage visitors to arrange a consultation before drawing conclusions from general content.
3. Engagement of Legal Services
A legal services engagement with Sejahtera commences only upon the execution of a formal engagement letter or, where appropriate, written confirmation from Sejahtera confirming the scope of work and applicable fees. Submission of an enquiry through this website does not in itself create a solicitor-client relationship.
Our principal services are described on this website as follows:
- Estate Position Review (RM 260): A considered first session covering estate planning matters and inheritance considerations, followed by a written summary.
- Will and Trust Structure Drafting (RM 710): Careful preparation of wills and supporting estate-planning instruments suited to the client's particular family and asset circumstances.
- Full Estate Stewardship Engagement (RM 1,410): A comprehensive engagement for clients with substantial or complex estate matters requiring ongoing support and full documentation.
The specific scope, deliverables, and timeline of each engagement will be set out in the applicable engagement letter.
4. Fees and Payments
Fees for our services are as stated at the time of engagement and will be confirmed in the engagement letter. Prices are quoted in Malaysian Ringgit (RM) and are inclusive of all applicable taxes unless otherwise stated.
Payment terms are set out in the engagement letter. Where a deposit is required prior to commencement of work, this will be stated clearly. For ongoing engagements, invoices will be issued at intervals agreed in the engagement letter.
Sejahtera reserves the right to adjust its fee schedule from time to time. Any revision to fees affecting an existing engagement will be communicated and agreed in writing before taking effect.
5. Client Responsibilities
To allow us to serve you well, we ask that you:
- Provide accurate, complete, and timely information relevant to your engagement.
- Inform us promptly of any changes in your circumstances that may affect the matter we are advising on.
- Review documents provided by Sejahtera carefully and raise any questions or concerns before execution.
- Keep copies of all executed documents in a safe and accessible location.
Sejahtera cannot be held responsible for advice given or documents prepared on the basis of incomplete or inaccurate information provided by the client.
6. Confidentiality
All information shared with Sejahtera in the course of an engagement is treated as strictly confidential and is subject to solicitor-client privilege. We will not disclose your confidential information to any third party without your consent, except where we are required to do so by law or court order, or where disclosure is necessary to provide the services you have engaged us for (such as coordination with co-advisors you have approved).
Confidentiality obligations apply to all practitioners and staff within Sejahtera and continue after the conclusion of an engagement.
7. Intellectual Property
The content of this website — including text, design, structure, and layout — is the property of Sejahtera and is protected under applicable intellectual property laws. You may view and print content from this website for your personal, non-commercial use only.
Documents prepared specifically for you as part of an engagement remain the property of Sejahtera until fees due in connection with their preparation have been settled in full, at which point ownership passes to you as the client.
8. Limitation of Liability
Sejahtera will exercise reasonable professional care and skill in delivering legal services. Our liability to you in connection with any engagement is limited to direct losses arising from our negligence or breach of professional duty, and will not in any circumstances exceed the fees paid by you for the specific matter in question.
We accept no liability for any loss arising from:
- Reliance on general information published on this website without obtaining specific legal advice.
- Decisions made on the basis of incomplete information provided to us by you or a third party.
- Delays, technical failures, or interruptions affecting delivery of digital communications.
- Changes in law or regulation occurring after the date on which advice was given.
9. Third-Party Links
This website may contain links to external websites for convenience. Sejahtera is not responsible for the content, accuracy, or privacy practices of those sites. The inclusion of a link does not constitute an endorsement or recommendation. We encourage you to review the terms and privacy policies of any external site you visit.
10. Termination of Services
Either party may bring an engagement to a close upon reasonable written notice to the other. Sejahtera reserves the right to conclude an engagement if circumstances arise that are inconsistent with our professional obligations, including where a conflict of interest is identified or where we are unable to obtain instructions necessary to continue acting.
On conclusion of an engagement, Sejahtera will provide you with the documents prepared on your behalf (subject to settlement of outstanding fees) and will retain copies of the file in accordance with our data retention policy.
11. Governing Law
These terms and any dispute arising from them or from services provided by Sejahtera shall be governed by and construed in accordance with the laws of Malaysia. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Amendments
We may update these Terms and Conditions from time to time to reflect changes in our practice or applicable law. Revised terms will be posted on this page with an updated date. Continued use of this website or engagement of our services following an update constitutes acceptance of the revised terms.
Where a material change affects an existing engagement, we will notify you directly before the change takes effect.
